An Agreement Written to Be Kept
These Terms & Agreements (the "Terms") form a binding legal contract between you ("you," "the player," or "the user") and Permington ("Permington," "we," "us," or "the Administration"), governing your access to and use of The Lost Codex and every service, client, website, account, and feature connected to it (together, the "Service"). They are written in plain language on purpose: a game is only fair when its rules are clear, and these Terms are meant to be read and understood, not skimmed and ignored.
The Lost Codex is a persistent, shared online world. What one person does affects everyone else who plays. For that reason these Terms are firm, and they are designed to leave no shelter for those who would cheat, scam, dupe, exploit, bots, or defraud their way past the people who play honestly. The Service is operated by Permington and protected by these Terms together with the Rules & Regulations and the Privacy Policy.
- Ignorance is no defence. Not having read or understood these Terms or the Rules does not excuse a breach of them.
- Intent is not required. A violation is a violation whether or not you meant to commit it; "I didn't know it would do that" is not a shield.
- Exploiting a loophole is itself a breach. Abusing a gap, oversight, bug, or wording technicality is treated as if the prohibited act were written out in full.
- Penalties are minimums. Every penalty stated is a floor, not a ceiling, and may be escalated up to a permanent ban at the Administration's discretion.
- Enforcement may be retroactive. Conduct may be acted upon when it is discovered, even long after it occurred, including the reversal of gains.
- The official English version controls. Where any translation conflicts with the English text of these Terms, the English text prevails.
Acceptance of Terms
By creating an account, downloading, installing, accessing, or playing The Lost Codex in any way, you confirm that you have read these Terms and that you accept them in full and agree to be bound by them. Acceptance is a condition of access: there is no part of the Service you may lawfully use without it.
If you do not agree to these Terms in their entirety, you must not create an account, must not download or install the client, and must not access or play the Service. Your only remedy for disagreement is to stop.
These Terms may change from time to time as described in Article XVII. Your continued access to or use of the Service after any change takes effect constitutes your acceptance of the amended Terms. If you do not accept a change, your sole option is to stop using the Service.
Eligibility & Age
You may use the Service only if you are of the legal age required to enter into a binding contract in your country, state, or jurisdiction of residence. If you are under that age, you may use the Service only with the verifiable consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf and to be responsible for your conduct.
Each account is the responsibility of exactly one natural person. A parent or guardian who permits a minor to play accepts full responsibility for everything done on that account, including any purchases, breaches, or penalties.
You confirm that you are not barred from receiving the Service under the laws of any applicable jurisdiction, and that the information you provide on registration is true, current, and complete.
Licence to Play — Accounts & Content Are Licensed, Not Owned
Subject to your continued compliance with these Terms, Permington grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and play The Lost Codex for your own personal, non-commercial entertainment. This is the only right you receive. No ownership of any part of the Service passes to you.
All accounts, characters, levels, items, equipment, Master Points (MP), in-game currency, ranks, cosmetics, and every other virtual good or feature remain the sole and exclusive property of Permington at all times. They are licensed to you for use inside the game; they are not your property, they are not money, and they have no real-world monetary value.
Because these things are licensed and not owned, Permington may at any time and for any reason — including operation, balance, security, or enforcement — modify, suspend, reset, re-value, revoke, or remove any account, character, item, MP, currency, or virtual good, in whole or in part, with or without notice. You acquire no expectation of permanence in any account or virtual good, and no such change entitles you to any refund, credit, or compensation.
You may not copy, decompile, reverse-engineer, modify, or create derivative works of the client or the Service except to the limited extent that applicable law expressly permits despite this restriction.
Code of Conduct
The full Rules & Regulations are incorporated into these Terms by reference and form part of your agreement with Permington. By accepting these Terms you also accept the Rules, and a breach of the Rules is a breach of these Terms. Summarised, and without limiting the Rules, the following conduct is prohibited:
- Scamming & fraud — deceiving another player to take items, MP, currency, accounts, or real money by trickery, false promises, fake trades, or impersonation.
- MP farming & leeching — manipulating, boosting, leeching, or otherwise gaining Master Points or rankings by any means other than legitimate play.
- Abusing bugs, glitches & dupes — failing to report a bug you become aware of, or actively using, repeating, sharing, or profiting from any bug, glitch, exploit, or item-duplication method.
- Bypassing the Middleman — evading the official Middleman system where it is required, or structuring trades to escape its protections and audit trail.
- Bots, macros & third-party software — using automation, scripts, macros, bots, modified or unofficial clients, packet editors, or any third-party software that interacts with the Service.
- Harassment & hate speech — targeted abuse, threats, sexual harassment, bigotry, or hateful conduct toward any player or staff member.
- Impersonation & phishing — pretending to be staff, another player, or Permington, or attempting to obtain another person's credentials or personal data.
- Advertising rival servers — promoting, recruiting for, or linking to competing or private servers within the Service or its community channels.
- Real-world threats & illegal conduct — threats of real-world harm, sharing illegal content, or using the Service to commit or facilitate any unlawful act.
This list is not exhaustive. The spirit of fair play governs conduct that no list could fully anticipate: where an act is dishonest, abusive, or unfair to other players, it is prohibited whether or not it appears above, and the Administration may act on it accordingly.
Anti-Cheat, Exploits & Duplication
Permington maintains a strict zero-tolerance policy on cheating, exploitation, and duplication. Using, attempting to use, sharing, publishing, teaching, buying, or selling any bug, glitch, exploit, item-duplication method, or unintended game mechanic is strictly prohibited and is grounds for an immediate permanent ban.
The same applies to any automation, bot, macro, memory editor, debugger, injector, packet manipulation, speed-hack, modified or unofficial client, or other third-party tool that reads, alters, or interacts with the Service. Possession or distribution of such tools in connection with the Service is itself a breach.
Where cheating, exploitation, or duplication is found, Permington may impose a permanent ban, apply a hardware (HWID) and IP block, and perform a full rollback or confiscation across all accounts linked to the offender by any identifier, including accounts that received the proceeds. You acknowledge that detection and anti-cheat software may run alongside the client and may collect technical data necessary to detect and prevent cheating, as described in the Privacy Policy.
If you discover a bug, exploit, or dupe, you must report it promptly through official channels and must not use or spread it. Silence about an exploit you knowingly benefit from is treated as use of that exploit.
Fair Play, MP & Kruma
Master Points (MP), karma, caste ranks, ladder standings, and every competitive reward in the War of the Three Gods and the Kruma battlegrounds must be earned legitimately through genuine play. They exist to honour real achievement, and that meaning is destroyed by manipulation.
Manipulating, inflating, leeching, win-trading, kill-trading, account-sharing for competitive gain, boosting, or arranging matches or kills to obtain MP, rank, or reward is prohibited. Such gains are not earned and may be reversed, reset, or stripped at any time, with no compensation.
Both sides of an arrangement are equally liable. The organiser, the booster, the boosted beneficiary, and anyone who knowingly participates in or profits from a manipulation share responsibility and may each be penalised, up to a permanent ban.
Trading & the Official Middleman
Where a trade is high-value, or where the Rules require it, you must use the official Middleman system. The Middleman exists to protect players from scams and to keep an auditable record of significant transactions.
Trades conducted outside the official system — "off-system" trades, trust trades, or side deals — are entirely unprotected. Permington is under no obligation to investigate, reverse, or compensate any loss arising from an off-system trade. Such trades remain auditable, and where they are found to be fraudulent, exploitative, or in breach of these Terms, any items, MP, or currency involved may be confiscated from any party.
The sale, purchase, gifting, or transfer of an account between persons is not supported and is undertaken entirely at your own risk. Permington does not recognise, mediate, or guarantee any account transfer; all penalties, Violation Points, and history remain attached to the account regardless of who holds it; and a "stolen" or "bought" account remains the property of Permington and may be recovered or terminated at any time.
Virtual Goods, Purchases & No Refunds
The Service may offer virtual goods, currency, cosmetics, and other items for purchase or in exchange for donations through the webshop or official channels. Every virtual good is a licence to use that good inside the game under Article III; it is not property, not real currency, and has no real-world monetary value.
All purchases and donations are final and non-refundable. Once a purchase is completed or a virtual good is delivered or credited to your account, it cannot be refunded, exchanged, or reversed, except where a non-waivable right to a refund is required by applicable law, in which case the refund is limited to the minimum that law requires.
Prices, contents, availability, bundles, and promotions may change at any time and without notice, and a later change in price or offer does not entitle you to a refund or adjustment on a past purchase. Limited-time offers expire when stated.
No suspension, ban, confiscation, rollback, reset, or other enforcement action — however it arises — entitles you to any refund, credit, restoration, or compensation for any purchase, donation, or virtual good, including goods you can no longer access because your account was actioned.
Chargebacks & Payment Fraud
Initiating a chargeback, payment reversal, or dispute on a completed and delivered purchase, or paying with a stolen, unauthorised, or fraudulent payment method, is a serious act of fraud against Permington and against the community whose game it funds.
Any account associated with such a chargeback, dispute, or fraudulent payment is subject to an immediate permanent ban, an IP and hardware (HWID) block, and the forfeiture of all items, MP, currency, characters, and virtual goods on that account and on any linked account. This consequence applies whether or not the disputed funds are ultimately recovered, and even if the chargeback is later withdrawn.
If you have a genuine billing problem — a double charge, an undelivered item, an unauthorised charge you did not make — you must contact the Administration first and allow us a reasonable opportunity to investigate and resolve it. Going to your bank or payment provider before contacting us is treated as payment fraud under this Article.
Account Security & Responsibility
You are solely responsible for keeping your login credentials secret and secure, and for every action taken on your account, whether or not you authorised it. Activity performed through your account is treated as your own.
Staff and the Administration will never ask you for your password. Anyone who does is attempting to phish you; do not share it, and report the attempt. We may, but are not obliged to, offer additional security features such as two-step verification, which you are encouraged to use.
Permington is not liable for any loss, theft, or compromise of your account or its contents arising from your sharing, selling, or transferring of the account, from weak or reused passwords, from phishing or social engineering you fall for, or from malware on your own device.
All penalties, Violation Points, bans, and enforcement history attach to the account itself and remain in force regardless of who currently holds, buys, or recovers it.
User Content & Communications
"User Content" means anything you submit, post, or transmit through the Service, including character and guild names, chat and voice messages, guild descriptions, profiles, emblems, and any feedback or submissions you make.
By providing User Content, you grant Permington a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable licence to host, store, use, reproduce, modify, display, and distribute that content as needed to operate, promote, and improve the Service. You confirm that you have the right to grant this licence and that your content does not infringe anyone else's rights.
You are responsible for your User Content and the consequences of sharing it. Permington may, at its discretion and without obligation, review, filter, refuse, remove, or rename any User Content that is unlawful, infringing, deceptive, abusive, or otherwise objectionable or in breach of these Terms or the Rules & Regulations.
Enforcement, Violation Points & Termination
Breaches of these Terms or the Rules are enforced through a cumulative Violation Point framework. Confirmed violations add Violation Points to the account, and a total of three (3) Violation Points results in a permanent ban. Serious breaches — including cheating, duplication, real-money fraud, and chargebacks — may carry an immediate permanent ban without passing through the point ladder.
The penalties stated throughout these Terms and the Rules are minimums. The Administration may, at its sole discretion, warn, mute, suspend, restrict, reset, roll back, confiscate from, or permanently terminate any account at any time, and may escalate any penalty up to a permanent ban in light of the severity, repetition, or impact of the conduct.
Ban evasion is itself a grave offence. Attempting to evade a penalty using alternate, secondary, or new accounts resets and extends the original penalty, and that penalty — along with any associated bans and blocks — is applied across all accounts linked to you by any identifier, including IP and hardware.
The Administration's enforcement decisions are made in good faith and are final. Submitting an appeal does not pause a penalty, and there is no right to play; access to the Service is a privilege that may be withdrawn in accordance with these Terms.
Service Availability, Changes & Beta Nature
The Service is provided on an "as is" and "as available" basis and is under continuous, active development. Features, content, balance, economies, maps, classes, and rewards may be added, changed, rebalanced, reset, wiped, or removed at any time as the game evolves.
Downtime, scheduled and unscheduled maintenance, patches, latency, bugs, and balance changes are an expected and ordinary part of an online game and of early-access and beta builds. Permington does not guarantee that the Service will be uninterrupted, error-free, secure, or available at any particular time.
Permington may modify, suspend, take offline, or discontinue the Service or any part of it — including entire worlds, characters, or data — temporarily or permanently, with or without notice. No guarantee is made as to the preservation of any account, character, progress, item, or data, and no interruption, change, or discontinuation entitles you to any refund or compensation.
Disclaimers & Limitation of Liability
To the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Permington does not warrant that the Service will meet your requirements or be uninterrupted, timely, secure, or error-free.
To the maximum extent permitted by applicable law, Permington and its officers, employees, and contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, nor for any loss of data, loss of profits, loss of goodwill, or loss of virtual goods, accounts, items, MP, or currency, arising out of or relating to your use of or inability to use the Service.
Permington is not responsible for the conduct of other users or third parties, including scams, harassment, off-system trades, or external sites and tools. Where liability cannot lawfully be excluded, Permington's total aggregate liability to you is limited to the amount, if any, you paid to Permington in the ninety (90) days before the event giving rise to the claim. Nothing in these Terms excludes any liability that cannot be excluded under applicable law.
Indemnity
You agree to indemnify, defend, and hold harmless Permington and its officers, employees, and contributors from and against any claims, demands, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your breach of these Terms or the Rules & Regulations, your misuse of the Service, your User Content, or your violation of any law or of the rights of any third party.
Privacy
Your personal data is collected and handled in accordance with the Privacy Policy, which forms part of these Terms. The Privacy Policy explains what we collect, why, how it is used and protected, and the choices available to you.
By creating an account and using the Service, you consent to the collection and use of your data as described in the Privacy Policy, including technical and anti-cheat data necessary to operate and protect the Service.
Changes to These Terms
Permington may amend these Terms at any time, with or without prior notice, to reflect changes in the Service, the law, or our practices. The current version is the version published here, and the "Last updated" date marks when it last changed.
Where a change is material, we will make reasonable efforts to announce it through official channels where practical. Your continued access to or use of the Service after a change takes effect constitutes your acceptance of the amended Terms. If you do not accept a change, you must stop using the Service.
Governing Terms, Severability & Controlling Version
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision is severed to the minimum extent necessary and the remaining provisions continue in full force and effect. A failure by Permington to enforce any provision is not a waiver of that provision or of any other.
These Terms may be published in more than one language for convenience. The official English version controls, and in the event of any conflict or difference in meaning between the English text and any translation, the English text prevails.
These Terms & Agreements, together with the Rules & Regulations and the Privacy Policy, constitute the entire agreement between you and Permington concerning the Service and supersede any prior understanding on that subject.
